Voice and Audio Data Policy

This Voice and Audio Data Policy ("Audio Policy") explains how Speakyboo, Inc. ("Speakyboo," "we," "us," or "our") captures, processes, and handles voice input and audio data in connection with our AI-powered voice dictation and transcription platform available at speakyboo.com (the "Service"). This policy supplements our Privacy Policy and is intended to provide clear, specific information about our practices with respect to your voice.

We understand that voice is among the most personal categories of data. Your voice is biometric in nature, uniquely tied to your identity, and deserves exceptional care. We have designed the Speakyboo architecture to minimize the footprint of your audio data and to give you maximum control over how your voice is used.

1. How Audio Is Captured

Speakyboo captures audio exclusively through your device's microphone, accessed via your web browser's Web Audio API or our native application interface. Audio capture is always user-initiated. Recording begins only when you explicitly press the record button or activate dictation using the designated keyboard shortcut or UI control. Recording ends when you press stop or release the control.

We do not engage in continuous, ambient, background, or passive listening. The microphone is never activated without your direct and deliberate action. We do not activate the microphone during application loading, navigation, or any period when you have not initiated a dictation session.

When your browser grants microphone access to Speakyboo, that permission is scoped to the active session and the specific tab or window. We request microphone access each time a new browser session is initiated, consistent with modern browser security models. We do not request persistent microphone access tokens that would allow activation without your knowledge.

2. What Happens to Your Audio

Audio captured through Speakyboo is transmitted in real time or in short segments to the Google Gemini API for speech-to-text transcription. This is the sole purpose for which your audio is transmitted. The transcription happens at the API level, and the resulting text is returned to Speakyboo and presented to you in the interface.

Speakyboo does not store, archive, or retain raw audio files on its own servers. Once your audio is transmitted for transcription and the transcript is returned, the audio data is discarded. We do not maintain a library of user voice recordings. We do not build voice profiles or voiceprints from your audio. We do not use your audio to train proprietary speech models.

Audio transmission to Google Gemini API occurs over encrypted connections using TLS. Google's data handling practices for the Gemini API are governed by Google's terms of service and data processing agreements, which are separate from this policy. We encourage you to review Google's API Data Processing Terms at cloud.google.com/terms.

Speakyboo's infrastructure is hosted on Cloudflare's network. While audio segments may transit Cloudflare's edge network during transmission to the Gemini API, Cloudflare does not process audio content for purposes beyond secure delivery.

3. User Consent and Microphone Permission

Before Speakyboo accesses your microphone for the first time, your browser will display a permission prompt asking whether you allow speakyboo.com to access your microphone. You must affirmatively grant this permission. If you deny permission, the dictation feature will be unavailable and no audio will be captured. No other feature of Speakyboo requires microphone access.

You may revoke microphone permission at any time through your browser settings. Instructions for revoking permissions vary by browser:

  • Chrome: Click the lock icon in the address bar, select Site settings, and change Microphone to Block.
  • Firefox: Click the lock icon, select Connection secure, then More information, and navigate to Permissions to revoke microphone access.
  • Safari: Go to Safari menu, Preferences, Websites, Microphone, and set speakyboo.com to Deny.
  • Edge: Click the lock icon in the address bar and adjust microphone permissions under Permissions for this site.

Revoking microphone permission prevents future audio capture but does not affect transcripts already saved in your account.

4. No Background Recording

Speakyboo does not record audio in the background, in the foreground without your initiation, or at any time outside an active, user-initiated dictation session. Our application code does not include any functionality for ambient audio capture, keyword detection, wake-word listening, or passive voice monitoring of any kind.

When you are not actively dictating, the microphone is inactive. When you navigate away from the dictation interface, close the browser tab, or log out, any active audio stream is immediately terminated. We do not leave audio streams open after sessions end.

5. Transcription Accuracy

Speakyboo uses Google Gemini's speech recognition capabilities to convert your spoken words into text. Transcription accuracy depends on factors including microphone quality, background noise levels, speaker accent, speech clarity, and the technical vocabulary of the content being dictated.

Speakyboo applies additional AI-based processing to the raw transcription output to improve grammar, punctuation, sentence structure, and overall readability. This polishing step occurs after transcription is complete and operates on text, not on audio.

Speakyboo makes no warranty regarding transcription accuracy. You are responsible for reviewing and editing all transcribed text before relying on it for any purpose. Transcripts should not be used for medical, legal, or other sensitive applications without independent review.

6. Transcript Storage and Retention

Transcripts you generate using Speakyboo are stored in your account on our servers hosted on Cloudflare's infrastructure. Transcripts are retained for as long as your account is active. You may delete individual transcripts at any time from your documents library within the application. Deleted transcripts are removed from our active database immediately and purged from backup systems within 30 days.

Upon account deletion, all transcripts and documents associated with your account are permanently deleted within 30 days of your deletion request. See our Data Retention Policy at speakyboo.com/policies/data-retention for detailed retention periods across all data categories.

You may export all of your transcripts at any time in plain text or other available formats from your account settings. Data portability is a right we respect and facilitate.

7. Third-Party Processing

The third-party services that may process your audio or transcript data are:

  • Google Gemini API: Receives your audio for real-time speech-to-text transcription. Google's processing of this data is subject to the Google Cloud Data Processing Addendum. We have executed a data processing agreement with Google that requires it to process your audio only for the purpose of providing transcription services and prohibits Google from using your audio to improve general AI models without your consent.
  • Cloudflare: Provides infrastructure for our web application, including our edge network and database (Cloudflare D1 and R2). Cloudflare processes data in accordance with its Data Processing Addendum and does not use customer data for advertising purposes.

We do not share your audio or transcripts with any other third parties, including advertising networks, analytics providers, or data brokers.

8. Your Rights Over Voice Data

You have meaningful control over the voice data you generate through Speakyboo:

  • Access: You can view all transcripts stored in your account at any time through the documents library.
  • Deletion: You can delete individual transcripts or your entire account and all associated data at any time. Because we do not store raw audio, audio deletion is not separately applicable.
  • Export: You may export all your transcripts in structured formats from your account settings.
  • Correction: You may edit any transcript directly in the Speakyboo interface.
  • Objection: You may stop using the dictation feature at any time. All other features of Speakyboo remain available without microphone access.

9. Children's Protection

Speakyboo's Service is not directed at children under 13 years of age. We do not knowingly collect audio, voice data, transcripts, or any other personal information from children under 13. If we become aware that we have inadvertently collected personal information from a child under 13, we will delete such information immediately.

If you are a parent or guardian and believe your child under 13 has created a Speakyboo account or provided audio data, please contact us immediately at privacy@speakyboo.com and we will take prompt action to delete the account and all associated data.

Given the biometric nature of voice data, we apply heightened protections for users aged 13 through 17. Users in this age range may only use Speakyboo with verifiable parental or guardian consent. If you are under 18, please have a parent or guardian review these policies before using the Service.

10. GDPR Rights for Voice and Biometric Data

If you are located in the European Economic Area (EEA), the United Kingdom, or Switzerland, the following additional rights apply to your voice and biometric data under the General Data Protection Regulation (GDPR) and equivalent national laws:

  • Legal Basis: We process your audio data on the basis of your explicit consent (Article 6(1)(a) and Article 9(2)(a) GDPR), which you provide when granting microphone permission and initiating a dictation session.
  • Right of Access (Article 15): You may request a copy of the personal data we hold about you, including transcripts.
  • Right to Erasure (Article 17): You may request deletion of your voice-derived data (transcripts) at any time. Because raw audio is not retained, erasure of audio itself is automatic upon session completion.
  • Right to Withdraw Consent: You may withdraw your consent to audio processing at any time by revoking microphone permissions and ceasing use of the dictation feature. Withdrawal does not affect the lawfulness of processing before withdrawal.
  • Right to Data Portability (Article 20): You may request an export of your transcript data in a structured, commonly used, machine-readable format.
  • Right to Lodge a Complaint: You have the right to lodge a complaint with your local supervisory authority if you believe your data protection rights have been violated.

11. CCPA Rights for Voice and Biometric Data

If you are a California resident, your voice-derived data may qualify as biometric information under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA). The following rights apply:

  • Right to Know: You have the right to know what categories of personal information we collect, including whether we collect biometric data. As described in this policy, we transmit audio to Google Gemini for transcription and do not retain raw audio ourselves.
  • Right to Delete: You may request deletion of personal information we have collected from you, including transcripts. We will fulfill verified deletion requests within 45 days.
  • Right to Opt Out of Sale: We do not sell your personal information, including voice data or transcripts, to third parties. No opt-out is required, but it is your right to confirm this.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any CCPA rights, including by denying services, charging different prices, or providing a different quality of service.

To submit a verified CCPA request, contact privacy@speakyboo.com with the subject line "CCPA Data Request." We may ask you to verify your identity before processing the request.

We will acknowledge your request within 5 business days and respond fully within 30 days. For complex requests, we may extend this period by an additional 30 days, in which case we will notify you of the extension.
