By using the Service, you acknowledge and accept the limitations and disclaimers set forth below.
1. Transcription Accuracy Disclaimer
Speakyboo is powered by AI-based automatic speech recognition (ASR) and natural language processing technology. While we strive to deliver high-quality transcriptions, this technology is inherently imperfect and cannot guarantee 100% accuracy under all conditions. Transcription results may be affected by a wide range of variables including but not limited to: accent, dialect, speech patterns, pronunciation, background noise, microphone quality, ambient environment, audio compression, internet connection quality, speaker health and fatigue, technical vocabulary, proper nouns, and simultaneous or overlapping speech.
You are solely responsible for reviewing, verifying, and correcting all transcribed text before relying on it or using it for any purpose. Do not assume that any transcription produced by the Service is an exact or complete representation of what was spoken. Speakyboo makes no warranty of any kind regarding transcription accuracy and shall not be liable for any errors, omissions, or inaccuracies in transcription output.
2. AI Rewriting and Output Disclaimer
Speakyboo's AI rewriting features apply automated language processing to your raw transcripts in order to improve readability, grammar, punctuation, and structure. These AI-generated refinements are produced by large language models and may alter the meaning, tone, emphasis, or specific wording of your original spoken content. The AI does not understand your intent — it makes statistical inferences about language.
Outputs from AI rewriting features may differ from your original intent in ways that are subtle or significant. You must review all AI-rewritten content before using it for any purpose — personal, professional, commercial, legal, or otherwise. Speakyboo is not responsible for any divergence between your intended message and the AI-generated output. The AI rewriting feature is provided as a convenience tool, not a substitute for human editing or authorship review.
3. No Warranty on Service Availability
Speakyboo does not warrant that the Service will be available, uninterrupted, timely, or error-free at all times. The Service may be temporarily unavailable due to scheduled maintenance, unplanned outages, infrastructure failures, third-party service disruptions, force majeure events, or other circumstances beyond our reasonable control.
We will make commercially reasonable efforts to maintain high availability and to communicate planned maintenance in advance. However, we do not commit to any specific uptime percentage unless expressly stated in a separate written Service Level Agreement (SLA) executed with you. Interruptions or degradations in Service availability do not entitle you to refunds or credits except as explicitly described in your subscription terms.
4. No Guarantee of Data Preservation
While Speakyboo maintains backup systems and data redundancy measures, we do not guarantee that your transcript data or account information will be preserved indefinitely or without loss. Data may be lost or corrupted due to hardware failures, software defects, network issues, cyberattacks, or other causes beyond our control.
You are strongly encouraged to maintain your own independent backups of any transcript content that is important to you. Export your transcripts regularly using the export features available in your account. Speakyboo shall not be liable for any loss of data, regardless of cause, and will not be obligated to restore lost data unless expressly agreed in writing.
5. Medical, Legal, and Financial Disclaimer
Speakyboo is a general-purpose productivity and writing tool. It is not a certified medical transcription service and is not designed, validated, or approved for use in clinical settings, electronic health record documentation, medical coding, or any healthcare application where accuracy is subject to regulatory requirements. The Service is not HIPAA-certified. You should not use Speakyboo for protected health information (PHI) without appropriate safeguards and legal review.
The Service is not a certified legal transcription service and is not appropriate as the sole method of creating verbatim legal records, court transcripts, deposition transcripts, or evidentiary documents without independent verification by a qualified human transcriptionist or court reporter.
Nothing produced by or through the Service constitutes medical advice, legal advice, financial advice, investment advice, tax advice, or any other form of professional advice. Any content generated by the Service does not create a professional relationship between you and Speakyboo. You should always consult qualified professionals for advice specific to your situation. Speakyboo shall not be liable for any decisions made in reliance on content generated by the Service.
6. Results Disclaimer
Results from using Speakyboo vary significantly from user to user and depend on many factors outside our control. These factors include but are not limited to: microphone quality and type, recording environment and background noise levels, speaking style, speed, and clarity, the complexity of vocabulary and subject matter, device specifications, internet connection speed and stability, browser and operating system compatibility, and the nature of the content being transcribed.
Testimonials, case studies, and descriptions of transcription quality published on our website or marketing materials represent individual experiences and are not representative of results that all users will achieve. Speakyboo makes no guarantee that you will achieve any particular level of accuracy, productivity improvement, or time savings from use of the Service.

Speakyboo does not endorse, control, or assume responsibility for the content, privacy practices, accuracy, or availability of any third-party websites or services. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SPEAKYBOO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO DAMAGES RESULTING FROM TRANSCRIPTION INACCURACIES, AI REWRITING ERRORS, DATA LOSS, SERVICE INTERRUPTION, OR RELIANCE ON SERVICE OUTPUT.
IN NO EVENT SHALL SPEAKYBOO'S AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE DISCLAIMERS OR YOUR USE OF THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100.00 USD). THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF SPEAKYBOO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to defend, indemnify, and hold harmless Speakyboo and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your reliance on any Service output, your violation of these Disclaimers or the Terms of Service, or your violation of any applicable law or third-party rights.
